Terms & Conditions –
the holding space

This document sets out the terms and conditions (“Terms”) under which Amanda Bull, trading as The Holding Space (“The Midwife”, “I”, “me”) provides private midwifery and postnatal care services (“Services”) to you (“the Client”, “you”).

1. Contract Formation

1.1 These Terms form a legally binding agreement between you and The Holding Space for the supply of Services once you book a Service and make payment.
1.2 A contract is formed on the earlier of:
  a) when you submit a booking through the online system and payment is confirmed; or
  b) when you and The Midwife agree verbally in writing to proceed.
1.3 If any term in these Terms conflicts with a specific written agreement between us, the written agreement will take precedence.

2. Services Provided

2.1 The Midwife will supply Services as set out in your booking confirmation and Service package.
2.2 Services are delivered at your home within the agreed service area (North Surrey and West London), or via remote consultation if agreed.
2.3 Services are tailored to your chosen package and do not constitute emergency medical care.
2.4 You agree that the Services provided are complementary to NHS care and do not replace any NHS or statutory care you receive.

3. Booking, Fees & Payment

3.1 Package prices are as listed on the website or provided in direct communication.
3.2 Bespoke or ad-hoc services are charged at:
  - £90 for 30 minutes (remote consultation)
  - £180 for 1 hour (minimum for home visit).
3.3 All fees must be paid in full before Services commence, unless an alternate written payment arrangement is agreed.
3.4 Payment can be made via bank transfer or card.
3.5 Booking confirmation is conditional on full payment except where a written alternative is agreed.

4. Communication & Availability

4.1 Clients with a booked package have WhatsApp access for non-urgent questions.
4.2 The Midwife will endeavour to respond within 4 hours, but this is not a clinical emergency response service.
4.3 For urgent medical issues, you must contact NHS 111 or 999 without delay.

5. Appointment Changes, Cancellations & Refunds

5.1 You may reschedule visits provided you give at least 48 hours’ notice.
5.2 Cancellations made within 48 hours of an appointment are non-refundable.
5.3 Refunds for unused package hours are calculated at the bespoke hourly rate and issued at The Midwife’s discretion.
5.4 If The Midwife needs to cancel a booked visit (e.g. due to illness or unforeseen events beyond control), she will reschedule or offer a refund for that visit.

6. Client Responsibilities

6.1 You must provide accurate and complete information about your medical history and circumstances.
6.2 You must ensure the environment for home visits is safe and suitable.
6.3 You understand that The Holding Space is not providing emergency medical services. For urgent clinical needs, you must use NHS services.

7. Liability

7.1 The Midwife will exercise reasonable skill and care in providing Services.
7.2 Nothing in these Terms limits liability for death or personal injury caused by negligence.
7.3 The Midwife will not be liable for indirect or consequential losses, loss of income, or loss of chance.
7.4 You acknowledge that outcomes vary and no clinical outcome can be guaranteed.

8. Data Protection & Confidentiality

8.1 Personal data will be used to deliver your care and kept in compliance with UK GDPR and applicable privacy regulations.
8.2 Information may be shared with other healthcare professionals involved in your care where clinically necessary or legally required.
8.3 A separate Privacy Policy sets out full information rights and how your data will be processed.

9. Changes to Terms

9.1 The Midwife may update these Terms from time to time due to changes in law, professional guidance, or service delivery requirements.
9.2 Where possible, you will be notified of material changes in advance. New Terms will apply to future bookings.

10. Governing Law & Jurisdiction

10.1 These Terms are governed by the laws of England and Wales.
10.2 Any dispute arising out of these Terms is subject to the non-exclusive jurisdiction of the English courts.

Definitions

Terms like “Services”, “Client”, “The Midwife”, and other capitalised terms shall have the meanings provided in your booking confirmation and these Terms combined.
